Musicians develop their own labels for many different reasons. My reason is partly because of a challenge I took on at a young age, to take what I was told was an unmarketable instrument, the violin, and create music that expressed emotions, touched hearts, and ultimately, sold. Whatever the reason for creating their own labels, musicians sometimes forget the advantages they hold and focus instead on the multitude of challenges.

As a gentle reminder to artists as well as their potential customers, I’m sharing my personal favorite reasons why I enjoy having my own label, and why music lovers should consciously choose to buy music from independent labels.

1. Independent musicians can freely express their passion and unique talent. They can express their own personal stories, follow their own instincts, and not have to follow orders from major label executives as to what they must create. From the customer’s perspective, by exploring radio stations and other sources of independent music, they too are now free to make their own decisions as to what is hot and what is not.

2. Many of the common music distributors only offer music from major labels, and rarely do they give anything for free, no matter how many albums you download or cds you buy. An independent artist is free to be unique and generous in his sales methods. For the consumer, this can mean getting bulk discounts, coupon offers and appreciation for their repeat purchases.

3. The independent musician can communicate directly with the customer, so online sales doesn’t have to feel like an isolating experience for the artist. Many times the thrill of receiving an email directly from the musician can turn an independent label music purchaser into a devout fan.

4. Niche marketing is all the buzz these days, and nowhere is it more successful than in independent music. As an independent musician, you are free to create your own unique niche and, in the process, reach more ideal fans. As someone who buys music from an independent label, you can find it easier to discover the music that defines and expresses YOU as well.

5. By buying from independent labels, customers and musicians can share the love. Think of it this way, here’s one scenario. A music lover makes a purchase. The independent musician has total control over what is communicated in the thank-you message. The customer can write back. The musician can quote the customer in his blog, the customer basks in the glory of the personal mention and shares it with all his friends on his Facebook page. Backlinks abound. Try that when you purchase from a major label.

6. Everyone feels more authentic. A MySpace page is more authentic than a billboard. A blog is more authentic than a press release. As an independent musician you can replace corporate communications with the real you, and your fans can comment on your webpage and get a direct response from you with their name on it.

7. At a time when many music retailers are closing their doors, customers can find their favorite independent musician’s music by buying it directly from the artist. Musicians with a well defined niche and loyal, avid fans can remain untouched by the ups and downs of the retail music industry.

8. An independent musician can develop his own website presence based on his own unique personality and style. Fans can hang out in a place where they can listen to new music clips, socialize, watch video performances, buy music, and share and build upon each other’s excitement. Everything is in one place, and they can discover a new musician or song, leave their comments, bookmark the site, make a purchase, and make new friends, all at the same time.

9. Musicians get a bigger cut from the sale of their music. This may seem obvious, but if customers could see the portions their favorite musicians receive from major labels, they would make more effort to support independent musicians, and buy from independent labels.

10.Indie musicians can band together to support each other and further their own causes, in organizations such as Association of Independent Musicians, or Rock the Net, only two examples. Major record labels often limit what their artists can do or not do. Consumers can not only support the music they love, they can affiliate themselves with causes they believe in.

There are of course other reasons to buy music from independent artists, but this is a great list to get you started thinking in that direction.

Dana Stone and Rick Washbrook meet in 1972 thats about 37 years ago at school in Aurora Ontario.   In fact Dana Stone was a student of Washbrooks later in his teens. They went on to being good friends through the years.
 
In there early 20′s they lived together with a band called the Stoves in London.  This is when Washbrook attended record production and engineering at Fanshaw Collage.  Dana Stone was sound man and publicist for the band.
 
Dana Stone himself is a Wonderful singer and writes well crafted songs. He has 3 CD’s out under his label. Has been in the music business all his life diving into many facets of the industry.
 
Washbrook booked most of his shows for the 23 years he played live or worked with an agent. But Dana was always there to advise him.

When was the last time you paid $12 or more for a CD? For many, it has been years. It’s really no wonder why so many people have stopped spending their hard earned money on overpriced CD’s. People used to go out and buy a CD because they heard one song on the radio that they really liked, and a lot of times that CD would only have one or two hit songs on it.

The Internet has changed how music is delivered to the consumer, as well as how music is marketed. With unit sales from traditional record labels down over the past few years, it seems evident that most music delivery is coming from online sources. Like many musicians, waiting for a record label to find you can take a long time and even then, it may not be worth it. Instead, musicians are taking matters into their own hands and selling music by promoting it on MySpace. Since MySpace reaches millions of viewers each day, chances are you will be able to sell your music, make a profit, and create a fan base without needing to sign a recording contract.


Being your own boss


Without a recording contract, you will be able to choose the songs for your CD, the order of those songs, and when you want to record them. You will also be able to design cover art, inside pages, and other merchandise you may want to sell in conjunction with the CD or music downloads.


You will also be able to choose if you want to strictly sell songs that can be downloaded or if you want to record an actual CD.


You can choose to sell your music in different ways by creating a web site where people can download songs, or working with third-party distribution web sites that will take of packaging and shipping. While MySpace is currently working on building a storefront where musicians can sell their merchandise directly on the site, you may have to create your own web site and sell your CD there until this new feature is up and running. But that doesn’t mean you cant advertise on MySpace, work with other musicians to cross-sell music, or find other ways to promote your sound.

A band web site should be an extension of your MySpace profile page. Include your web site on your profile page so fans will know where to go when they want to buy a CD, see additional photos, or find out where you will be playing next.


MySpace is a great way to promote your music and help your CD or downloadable songs sell even faster. The internet is a large landscape, but with a little help from MySpace, you will be able to let fans know where they can buy your music and learn more about your sound.

The purpose of a Performance Rights Organization is to figure out who’s music is getting played and then paying that artist, writer and publisher for public performances of their work.  It’s hard to put a price tag or a number on how important music is to the world but long ago, when the record business was just getting started, artists and writers of music argued that what they were doing was of some value to the world.  And radio stations and bars and clubs and concert halls and shopping malls all agreed, music definitely was good for business.  So around this time the first Performance Rights Organization was created.  It was called the American Society of Composers, Authors, and Publishers or ASCAP.  It’s job was to figure out all the ways and places in which music was being used publicly and how to turn that into dollars for the people creating the music.  They came up with a scheme that was pretty simple to understand and quite effective.  They did this by selling licenses to any place of business that used music. If you wanted to start a radio station you had to buy a license from ASCAP.  If you owned a club where live music was going to be performed you had to buy a license from ASCAP.  If you owned a store where you were going to play music to create a relaxing atmosphere for your shoppers, you had to buy a license from ASCAP.  And it remains the same today, but now there are three major organizations that collect performance money, one is ASCAP, another is BMI and the last is SESAC.  All do the exact same thing:  Collect money for artists, writers and publishers for the public performance of their songs.



Before we go any further let me explain a few ins and out of Performance Rights Organizations.   Let’s start with a few definitions:

Artist: The person performing the piece of music.  Some artists write their own music and lyrics, some do not.  As you will see there is quite an advantage to being a writer as far as Performance Rights Organizations are concerned.  In fact artists who only perform other people’s music do not get any money from the public performance of that music. The author of the lyrics and the music that the artist is performing is the one sitting back collecting checks!

Composer: The person writing the music.  In a traditional songwriting arrangement the person who makes the music gets half of the writer’s share.  More on that later.

Author/Lyricist: The person writing the words to the music the composer wrote.  As you know, not all music has lyrics, but for the last 70-80 years most popular music has.  In a traditional songwriting arrangement the person who writes the lyrics gets half of the writer’s share.  If there are two lyricists they must split the lyricist’s half in half. So two lyricists are each only getting a quarter of the total writer’s share.

Publisher: The publisher is someone who works for Artists, Composers, and Lyricists (and themselves) to publicize musical works.  This means it is their job to try to find ways to make money on the music they represent.  This may include getting a song placed in movies or on TV shows.  It can include getting songs used in commercials, it can even include helping artists get in touch with more people that can help them, like record labels, promoters etc.  The bottom line is that publishers are trying to get the music they represent to the public to make money for themselves and their Artists, Composers and their Lyricists.

Now, each Performance Rights Organizations has it’s own way of calculating how to pay their artists, composers, and publishers that I’ll look at in a later post, but all of them do a few things the same:

They all sell licenses to use their music. That means that someone wanting to start a radio station today must buy three licenses to broadcast music, one from ASCAP, one from BMI and one from SESAC.  That’s because Ciarra may be represented by one and T-Pain is represented by another.  If a radio station wants to play Ciarra’s music and T-Pain’s music it needs a license for both.  Remember: ASCAP, BMI and SESAC represent ALL the music made in the United States.

They all split the money they collect from licenses and pay half to the Writers of the music and half to the Publishers. What?  You mean if my song gets played I only get half the money?  Well, yes and no.  Let’s look at the typical arrangement first.  If you have a song on the radio that generates $10,000 dollars your Performance Rights Organization pays you $5000 and your publisher $5000.  Why?  Because Publishers are not paid by anyone, they make their money when you make your money.  Remember, it is the Publishers job to publicize your work, and what better motivation to get out there and make money for you than for them to also be making money for themselves.

“But I want ALL the money!” you say.  Ok, you can have it:  By being your own publisher. All the Performance Rights Organizations let you also start publishing companies with them so that you can collect your writer’s share and your publisher’s share!  And don’t be scared by the idea of starting your own company.  It’s as simple as coming up with a name that hasn’t been used and then giving your social security number and stating that you are the sole proprietor (I will go into further detail about different kinds of companies in a later post including what a ‘sole proprietor’ is).



All said, though, don’t underestimate the power of a publisher.  A good publisher is often well connected, much better connected to people who could use your music than you, so you need to weigh carefully the pros and cons of each scenario.  Then again, you can always start your own publishing company and then when a better opportunity presents itself you can re-assign your publishing rights to a bigger publisher.  Either way, never give away publishing rights for anything other than publishing.  Don’t trade beats for publishing.  Don’t give your lawyer publishing (unless they can prove that they can make you money publicizing your work).  Save your publishing for someone who can really do something for you.



Now, remember what I said earlier about how the Writer’s Share is traditionally carved up.  Traditionally, the writer of the music gets half of the writer’s share and the lyricist gets half of the writer’s share.  So of this $10,000 the lyricist will only get $2500, half of half!

You get the idea, it only gets worse the more lyricists you have on your song.  And look at that Publisher way up there with his $5000…makes you want to go into publishing doesn’t it!



Lastly, I’d like to point out that there is no artist in this equation.  You better be an artist who writes, or composes music if you want to get paid this way.  Better yet, be an artist who does both…and has their own publishing company!
